Article 112: Thai Lese Majeste Law Awareness Campaign

Context:

The number of those accused and prosecuted on charges of lese majeste, Article 112 of the Thai criminal code, has shown a shocking increase over the past five to six years. From 1992 to 2004, there was less than an average of less 10 cases of lese majeste tried in Thai courts, and thus the law’s effect was limited to a rather narrow circle. Recent scholarship indicates that from 2005 to 2009 there were 547 cases of lese majeste sent to trial on the Court of First Instance, the Appeals Court, and the Supreme Court levels—an average of 109 cases per year—during which 274 judgments were handed down for lese majeste. In 2009, there were an all-time high 164 lese majeste cases tried in the Court of First Instance. It is therefore necessary for the issue of lese majeste to be highlighted and made into a public issue in the hope that eventually there will be a change in this law.

Rationale:

The purpose of establishing the Article 112 Lese Majeste Awareness Campaign is to bring together individuals, organizations, and networks concerned about problems caused by Article 112 and its use. The position of the Article 112 Campaign is simply to make Article 112 a public issue. We believe that Article 112 (and its use) poses a serious threat to the right of freedom of expression and as such it cripples a key mechanism necessary for any democratic society. Regardless of whether one is wanting to amend or abolish the law, or even whether one supports the law but is concerned by the effects of its use, all are welcome to join the Article 112 Awareness Campaign.

The Thai and English name of the campaign differs as one is aimed at a national audience while the other focuses on an international audience. The Thai name is essentially the “Article 112 Awareness Campaign.” In English, it is the “Article 112: Thai Lese Majeste Law Awareness Campaign.”

The campaign begins with signatures from 112 persons, both foreign and Thai, from a wide variety of professions and positions—those involved in the media and law, academics, students, human rights activists, artists, those affected by the law, agriculturalists, those involved in religion, doctors, police, and so on. These 112 would help kick-off the campaign, but the campaign will maintain a list of any who share the belief that Article 112 needs to be addressed publicly.

Campaign Objectives:

1. in order to build and disseminate knowledge and understanding about the lese majeste law

2. in order to encourage debate, exchange, and solutions posed by the lese majeste law and its use

Campaign Kick-Off:

The hope is to kick-off the Article 112 Awareness Campaign in conjunction with an academic forum planned by the Rule of Law Group on 27 March 2011 at the Thai Prajan campus of Thammasart University (time to be determined). The event will be used to make a public announcement of the names of the 112 “charter members” (and any others) who are willing to publicly show support for the campaign. As there may be some of the 112 charter members who cannot attend, we ask for the attendance of anyone who can come. Those actually attending will be asked to donate 300 baht to the effort, and the first 112 persons attending the event will receive tee-shirts showing the Article 112 Awareness Campaign logo.

ตัวเลขผู้ถูกกล่าวหาและดำเนินคดีด้วยข้อหาหมิ่นพระบรมเดชานุภาพตามประมวลกฎหมายอาญา มาตรา 112เพิ่มขึ้นอย่างน่าตกใจในช่วง 5 – 6 ปีที่ผ่านมา งานศึกษาของเดวิด สเตร็กฟัสพบว่าเฉพาะเคสที่เป็นคดีในชั้นศาล ปี 2005สูงถึง 111 คดี จากเดิม 10 คดี ในปี 1992 แต่กระนั้นการรับรู้เกี่ยวกับปัญหาของกฎหมายดังกล่าวยังถูกจำกัดอยู่ในวงแคบ ดังนั้นจึงมีความจำเป็นที่จะต้องขยายประเด็นดังกล่าวให้กลายเป็นประเด็นสาธารณะเพื่อหวังว่าในที่สุดจะนำไปสู่การเปลี่ยนแปลงกฏหมายนี้

วัตถุประสงค์

1.       เพื่อสร้างความรู้และความเข้าใจเกี่ยวกับกฎหมายหมิ่นฯ

2.       เพื่อผลักดันให้เกิดการถกเถียง แลกเปลี่ยน และหาทางออกเกี่ยวกับกฎหมายหมิ่นฯ

รูปแบบกิจกรรมเบื้องต้น

เปิดตัวแคมเปญ “มาตรา 112: รณรงค์เพื่อตื่นรู้” หรือชื่อภาษาอังกฤษ “Article 112: Awareness Campaign” โดยขอจัดต่อจากเวทีวิชาการเรื่องกฏหมายหมิ่นฯของกลุ่มนิติราษฎร์ วันที่ 27 มีนาคม มหาวิทยาลัยธรรมศาสตร์ ท่าพระจันทร์ (เวลาจะแจ้งให้ทราบอีกครั้ง)

ในงานจะมีการแถลงรายชื่อ 112 รายจากหลากสาขาอาชีพ เพื่อเสนอให้เกิดการถกเถียง แลกเปลี่ยนและหาทางออกในเรื่องกฎหมายหมิ่นฯ (เป็นจุดยืนพื้นฐานที่มีร่วมกัน เนื่องจากการรณรงค์นี้ต้องการสนทนากับสาธารณชนเป็นหลัก จึงเปิดกว้างมากกว่าที่จะชูธงให้ยกเลิกหรือแก้ไขกฎหมายหมิ่นฯเพียงทางใดทางหนึ่ง แต่หากใครสนใจที่จะทำในแนวทางใดนอกจากนี้ สามารถทำได้ ถือเป็นแนวทางส่วนตัว ไม่ปิดกั้น)

สาขาวิชาชีพ ได้แก่ สื่อมวลชน นักกิจกรรม/ นักศึกษา แรงงาน นักกฏหมาย/นักสิทธิมนุษยชน (อดีต)ศาล ศิลปิน นักวิชาการ ผู้ได้รับผลกระทบจากกหมายหมิ่นฯ เกษตรกร กลุ่มศาสนา กลุ่มอื่นๆเช่น หมอ ตำรวจ ทหาร ฯลฯ  (หมวดวิชาชีพละประมาณ 10 คน)

มาตรา 112: รณรงค์เพื่อความตระหนักรู้

บริบทสถานการณ์

ตัวเลขผู้ที่ถูกกล่าวหาและถูกดำเนินคดีข้อหาหมิ่นพระบรมเดชานุภาพตามประมวลกฎหมายอาญามาตรา 112 เพิ่มสูงขึ้นอย่างมากในระยะเวลาห้าถึงหกปีที่ผ่านมา  ในระหว่างปี 2535 – 2547 ตัวเลขของคดีหมิ่นพระบรมเดชานุภาพที่มีการฟ้องร้องกันในศาลเฉลี่ยแล้วมีน้อยกว่า 10 คดี ดังนั้นผลกระทบจากกฎหมายดังกล่าวจึงยังจำกัดอยู่ในวงแคบ แต่ผลการศึกษาเมื่อไม่นานมานี้ชี้ให้เห็นว่า ระหว่างปี 2548 – 2552 ตัวเลขของคดีหมิ่นพระบรมเดชานุภาพมีมากถึง 547 คดี ที่ถูกนำไปพิจารณาคดีทั้งในระดับศาลชั้นต้น ศาลอุทธรณ์ และศาลฎีกา เฉลี่ยแล้วปีละ 109 คดี และมีศาลมีคำตัดสินแล้วจำนวน247 คดี (หมายถึงตัดสินว่าผิดกม.หมิ่นใช่ไหมคะ) ในปี 2547 เพียงปีเดียวมีการดำเนินคดีข้อหาหมิ่นพระบรมเดชานุภาพในระดับศาลชั้นต้นมากถึง 164 คดี ดังนั้น จำเป็นอย่างยิ่งที่จะต้องเน้นย้ำให้กฎหมายหมิ่นพระบรมเดชานนุภาพเป็นประเด็นสาธารณะด้วยหวังว่าจะมีการเปลี่ยนแปลงกฎหมายดังกล่าวในท้ายที่สุด

หลักการและเหตุผล

จุดประสงค์ของการริเริ่มการรณรงค์เพื่อความตระหนักรู้ในกฎหมายหมิ่นพระบรมเดชานุภาพ คือ การรวบรวมบุคคล องค์กร และเครือข่ายต่างๆ ที่มีความห่วงกังวลต่อปัญหาที่เกิดจากกฎหมายอาญามาตรา 112 และการบังคับใช้กฎหมาย ท่าทีของการรณรงค์ครั้งนี้คือ สร้างให้กฎหมายอาญามาตรา 112 เป็นประเด็นสาธารณะ พวกเรามีความเห็นว่ากฎหมายอาญามาตรา 112 และการบังคับใช้กฎหมายดังกล่าวเป็นปัจจัยคุกคามต่อสิทธิเสรีภาพในการแสดงออกซึ่งสิทธิดังกล่าวเป็นกลไกที่จำเป็นอย่างยิ่งต่อสังคมประชาธิปไตย ไม่ว่าบุคคลนั้นจะต้องการแก้ไข หรือยกเลิก หรือแม้แต่สนับสนุนกฎหมายดังกล่าวก็สามารถเข้าร่วมการรณรงค์เพื่อความตระหนักรู้ในกฎหมายอาญามาตรา 112 ได้ เพียงแต่บุคคลนั้นสนใจถึงผลกระทบที่ตามมาจากการใช้กฎหมายดังกล่าว

ชื่อภาษาไทยและภาษาอังกฤษของการรณรงค์ครั้งนี้จะแตกต่างกัน เพราะชื่อภาษาไทยนั้นมุ่งไปที่ผู้รับสารภายในประเทศ ในขณะที่ชื่อภาษาอังกฤษนั้นมุ่งไปที่ผู้รับสารในระดับระหว่างประเทศ โดยชื่อภาษาไทย คือ มาตรา 112: การรณรงค์เพื่อความตระหนักรู้ และชื่อภาษาอังกฤษ คือ มาตรา 112 การรณรงค์เพื่อความตระหนักรู้ในกฎหมายหมิ่นพระบรมเดชานุภาพของไทย

การรณรงค์จะเปิดตัวด้วยการแถลงรายชื่อบุคคลจากหลากหลายสาขาอาชีพทั้งคนไทยและชาวต่างชาติ จำนวน 112 คน ซึ่งรวมถึง สื่อมวลชน นักกฎหมาย นักวิชาการ นักเรียน นักสิทธิมนุษยชน ศิลปิน ผู้คนที่ได้รับผลกระทบจากกฎหมายดังกล่าวเกษตรกร ผู้ที่อยู่ในแวดวงทางศาสนา แพทย์ และเจ้าหน้าที่ตำรวจ โดยบุคคลทั้ง 112 คนนี้จะเป็นจุดเริ่มต้น อย่างไรก็ตามยินดีรับรายชื่อเพิ่มเติมจากผู้ที่เห็นพ้องแนวคิดว่า มาตรา 112 นั้นควรได้รับการถกเถียงกันในที่สาธารณะ
